2024 – Favorable settlement for confidential amount in wrongful death crash case in which intoxicated man on eBike was run over by equipment delivery truck
2009 – $325,000: Settlement for negligent security at apartment building in Opa-locka where young boy was shot on New Year’s Eve
2003 – $3,500,000: After eight days of trial, settlement of medical malpractice claim for paralysis from over-exposure to radiation given for treatment of mouth cancer
1999 – $1,500,000: Settlement of wrongful death claim against Miami-Dade Police for high-speed police chase resulting in death of bystander. Claims Bill authorizing full payment of settlement signed by Governor Jeb Bush, May, 1999
1991 – $1,000,000: Verdict against Cargill, Inc. for wrongful death in I-95 trucking accident (as co-counsel)
HEALTH INSURANCE CASES
2002 – $1,000,000: Settlement of claim for sexual abuse of two teenage girls at rehab facility, cash payment of $200,000 plus receipt of assignment of remaining claims against insurance carrier which bad faith claim later settled for undisclosed amount
2002 – Injunction: In favor of Cystic Fibrosis children obtained within four months of filing suit against Aetna compelling the HMO to pay for daily and life-time chest physiotherapy
1999 – $1,300,000: Initially obtained Summary Judgment for policy limits of $200,000 on student health insurance claim for heart/double lung transplant and later negotiated subsequent settlement of associated bad faith insurance claims for an additional $1,100,000
CIVIL RIGHTS AND GOVERNMENT CASES
2016 – Austin Carr was hired to defend the Florida Department of Transportation in a Turnpike exit traffic accident resulting in a double homicide. Austin Carr obtained a Defense Verdict for the FDOT
2012 – $1,900,000: Case tried as FTCA law suit against U.S. Army Corps of Engineers. Judgment for quadriplegia of 25 year old man as a result of diving accident on Miami Beach. Federal Judge assessed damages at $13,400,000 which were then reduced by comparative negligence and Fabre. (Award mentioned in Top 25 Verdicts and Settlements in 2012 by Daily Business Review, Miami)[subsequently reversed by 11th Circuit, cert denied by USSC]
1997 – $858,000: Verdict against the City of Hialeah for police brutality with soft tissue back injury and claim for violation of civil rights brought under 42 U.S.C. § 1983
